    El presente trabajo es un intento de aproximación al análisis de la figura de los CDS desde una perspectiva jurídica, como modalidad de contrato de derivados. Con ello, queremos destacar los aspectos de su régimen jurídico dejando más a un lado su carácter de derivado de crédito y su contemplación desde la perspectiva de los mercados donde se negocia. No obstante, la exposición se cierra con las normas que regulan su negociación en los mercados. ABSTRACT: This paper is an attempt to approach the analysis of the figure of the CDS from a legal perspective, while derivative contract mode. We intend to highlight aspects of their legal status, leaving aside their most credit derivative nature and contemplation from the perspective of the markets where it is traded. However, the exhibition concludes with the rules governing trading in markets.
