T1 Acomodación y exención por motivos religiosos en el ámbito escolar: A propósito de una reciente sentencia del Tribunal Europeo de Derechos Humanos

AB De forma recurrente, en el debate jurídico se cuestiona si los motivos religiosos o de conciencia justifican una excepción a exigencias normativas generales y aparentemente neutrales. El ámbito de los derechos educativos ha sido un área especialmente sensible a este debate, con un balance nada favorable al derecho de libertad religiosa y de conciencia: una reciente sentencia del Tribunal Europeo de Derechos Humanos del año 2017 abona dicha conclusión. Este artículo toma ocasión de esa sentencia para analizar las excepciones por motivos religiosos y su aplicación al ámbito educativo. Previamente, la investigación enmarca la sentencia en su ámbito geopolítico y en el contexto de la jurisprudencia del Tribunal de Estrasburgo. Si bien la sentencia podría resultar aceptable desde un punto de vista práctico, no es técnicamente satisfactoria y transmite un mensaje que, ligeramente extrapolado, pone en peligro la libertad de enseñanza y la libertad religiosa frente al protagonismo estatal en materia educativa.
AB Quite often in legal discussion it is questioned whether religious exemptions to apparently neutral laws are justified. The field of educational rights has been an area especially sensitive to this debate, with a negative result for freedom of religion or conscience. A recent ruling of the European Court of Human Rights of 2017 endorses this conclusion. This article takes occasion of that ruling to analyze religious exemptions in the educational sphere. Previously, the research frames the ruling in its geo-political context and in the context ofthe Strasbourg case-law. The article concludes that though this ruling may be acceptable from a practical point of view, it is not technically satisfactory and transmits a message that, slightly extrapolated, jeopardizes the freedom of education and religious freedom at the expense of higher governmental control of education.
