AB La jurisprudencia europea sobre la aplicación del art. 15 ha evolucionado. En su inicio, no valoraba la situación de hecho que exigía la suspensión, a juicio del Estado. Ahora entra a examinar la correcta valoración de algunos elementos de los hechos. No obstante, el TEDH entra a conocer sobre todo la interpretación y correcta o incorrecta aplicación del art. 15 por parte de los órganos nacionales. Este criterio interpretativo del TEDH apoya la propuesta de que la eventual suspensión del CEDH en España se realice por la vía de la declaración de los estados previstos en el art 116 CE (excepción o sitio). Debido a la cláusula interpretativa formulada por España, si el TCE considerase conforme a la Constitución las medidas adoptadas en un estado excepcional con aprobación del Parlamento, el TEDH debería ser aún más respetuoso con el margen de apreciación nacional al examinarlas.
AB The European jurisprudence on the application of art. 15 has evolved. In its beginning, it did not value the circunstancies that the suspension demanded, in the opinion of the national authorities. The ECHR now examines the correct assessment of some elements of the facts. However, the ECHR becomes aware of the interpretation and correct or incorrect application of art. 15 by national authorities. This interpretative criterion of the ECHR supports the proposal that the possible suspension of the ECHR in Spain be carried out by means of the declaration of the states provided for in article 116 Spanish Constitution (exception or site). Due to the interpretative clause formulated by Spain, if the Spanish Constitutional Court considers the measures adopted in an exceptional state with the approval of Parliament to be in accordance with the Constitution,the ECHR should be even more respectful of the margin of national assessment when examining them.
