AB La sociedad civil contribuye a la realización del Estado Social de Derecho mediante la constitución de fundaciones para fines de interés general y la participación en las actividades que éstas han de realizar en cumplimiento de sus fines fundacionales. Las fundaciones, instituciones de derecho privado, son el resultado de un proceso histórico, social y normativo en el que la intervención pública sobre las mismas ha estado siempre presente. El derecho de fundación para fines de interés general, reconocido en el apartado 1 del artículo 34 de la Constitución, está actualmente desarrollado por la Ley 50/2002, de 26 de diciembre, de Fundaciones, que atribuye al Protectorado de Fundaciones de competencia estatal, las funciones de “velar por el efectivo cumplimiento de los fines fundacionales, de acuerdo con la voluntad del fundador, y teniendo en cuenta la consecución del interés general” y de “verificar si los recursos económicos de la fundación han sido aplicados a los fines fundacionales”...
