AB Partiendo de que en el Derecho español el legatario adquiere la propiedad del legado de modo automático, se estudia la naturaleza de la renuncia al legado por parte de una persona jurídica pública. Al tratarse de un acto de administración extraordinaria, requerirá licencia de la Santa Sede, si excede de la cuantía determinada por la Conferencia Episcopal. Se estudia asimismo la eventual aplicación a este supuesto del régimen de renuncia a las ofrendas.
AB The legal status of the renunciation of a bequest on the part of a public legal entity is discussed in the context of the fact that under Spanish law legatees are automatically awarded the property set out therein. As an act of extraordinary administration, written permission from the Holy See is required if the amount of the bequestexceeds that established by the Episcopal Conference. The possible application of this principle to the renunciation of gifts or offerings is also explored.
