AB ¿Quién es trabajador en el Derecho de la Unión Europea?.Esta cuestión, la del ámbito subjetivo de aplicación del Derecho del Trabajo es, fue y seguirá siendo fundamental. En el seno de la UE, entre otros, los términos del debate son si hay un concepto uniforme, autónomo y comprehensivo de "trabajador" en ese ámbito supranacional.El estudio comienza con una aproximación, atendiendo al discurso, la semántica y el rol del TJUE en el Derecho del Trabajo de la UE. Después, se analiza la configuración normativa europea del concepto de trabajador; caracterizada por la subsidiariedad vertical, la fragmentación y la segmentación, distinguiendo dos grandes áreas, la política social de la UE y la relativa a las libertades de circulación.Por último, se analiza la aplicación horizontal del concepto de trabajador en el UE y la construcción del TJUE desde la libre circulación y el principio de igualdad
AB Who is “worker” in the EU Labour Law?The delimitation of the subjective scope of Labor Law is, was and will continue to be fundamental. Within the EU, is there a uniform, autonomous and comprehensive concept of "worker"?This research begins with an approach, taking into account the discourse and political discussion,  the reports,  the semantics and the role of the CJEU in the EU Labor Law. Secondly, the EU regulatory framework is analyzed; characterized by “vertical subsidiarity”, fragmentation and segmentation, distinguishing two broad areas, the EU Social Policy and the one related to freedom of movement. Finally, the “horizontal application” of the concept of worker in the EU and the construction of the CJEU from the free movement and the principle of equality is analyzed.
