T1 Institutional participation of “other” unions

AB El estudio aborda la participación institucional de los sindicatos menos representativos en el sistema de relaciones laborales español. En primer lugar, se analiza el criterio de la representatividad sindical como criterio delimitador de la propia participación institucional. A continuación, se revisa el reconocimiento de la participación institucional de estos sindicatos por la jurisprudencia constitucional y ordinaria, destacando cómo la jurisprudencia ha ido corrigiendo y equilibrando el alcance de la mayor representatividad en la materia.  En tercer lugar, se estudia la participación institucional de los sindicatos menos representativos en el ámbito autonómico, analizándose el tratamiento que las normas autonómicas ofrecen de la selección de los sindicatos menos representativos. Por último, se hace una breve referencia a la participación institucional de estos sindicatos en los Consejos autonómicos de participación institucional.
AB The study deals with the institutional participation of the least representative trade unions in the Spanish industrial relations system. Firstly, it analyses the criterion of trade union representativeness as a criterion delimiting institutional participation itself. It then reviews the recognition of the institutional participation of these unions by constitutional and ordinary case law, highlighting how case law has been correcting and balancing the scope of greater representativeness in this area. Subsequently, institutional participation at the regional level is studied, analysing the treatment that regional regulations offer for the selection of less representative trade unions. Finally, a brief reference is made to the institutional participation of these unions in the regional councils for institutional participation.
