AB Desde la conciencia de que la protección del medioambiente requiere una actuación más efectiva para preservar la biodiversidad, esta tesis se centra en estudiar dos formas específicas de delitos contra el medioambiente: la pesca ilegal, no declarada y no reglamentada (INDNR) y el tráfico de especies en una concreta área geográfica, las Islas Galápagos en Ecuador. El estudio analiza la problemática medioambiental en ese lugar protegido de la biosfera, con el fin de identificar las causas que afectan a la efectiva lucha contra esos delitos. Una vez identificados los concretos problemas y las deficiencias –tanto materiales como jurídicas– que para su resolución presenta el sistema de justicia penal de Ecuador, se intentará, a la luz de la experiencia de otros ordenamientos jurídicos (en particular, la de España), formular propuestas para superar algunas de las deficiencias detectadas. El objetivo principal consiste en examinar los problemas existentes y las medidas implementadas en la investigación y enjuiciamiento de los delitos medioambientales. Tal cometido se aborda desde la perspectiva del derecho y práctica ecuatorianos, pero con un enfoque crítico desde el prisma del derecho español, enmarcado en el derecho de la Unión Europea. AB With the awareness that environmental protection requires more effective action to preserve biodiversity, this thesis focuses on the study of two specific forms of environmental crime: illegal, unreported and unregulated (IUU) fishing and species trafficking in a specific geographic area, the Galapagos Islands in Ecuador.The study analyzes the environmental problems in this protected biosphere site in order to identify the causes that affect the effective fight against these crimes. Once the specific problems and deficiencies - both material and legal - in the Ecuadorian criminal justice system have been identified, an attempt will be made, in the light of the experience of other legal systems (particularly that of Spain), to formulate proposals to overcome some of the deficiencies detected.The main objective is to examine the existing problems and the measures implemented in the investigation and prosecution of environmental crimes. This task is approached from the perspective of Ecuadorian law and practice, but with a critical approach from Spanish law, within the framework of European Union law. The aim is to recognize the specific difficulties that arise in the investigation of IUU fishing and illegal trafficking of protected species and to assess the reasons for them.
