AB Este capítulo ofrece una introducción sistemática al marco jurídico universal y regional aplicable al control de armamentos y a sus principales desafíos. En primer lugar, distingue entre armas de destrucción masiva y armas convencionales, y revisa los instrumentos internacionales más relevantes destinados a limitar o prohibir determinadas categorías de armas y a mitigar el sufrimiento humano. En segundo término, centra el análisis en las armas pequeñas y ligeras, subrayando su impacto sostenido sobre la seguridad humana, la violencia y el crimen organizado, así como las dificultades estructurales para su regulación efectiva. El texto examina los principales desarrollos universales vinculados al tráfico ilícito y al comercio de armas y, posteriormente, contrasta dos experiencias regulatorias regionales: las Américas (con especial atención al marco interamericano) y África (a través de declaraciones y convenciones subregionales). Como conclusión, se identifican debilidades persistentes de implementación y de atribución de responsabilidades, y se plantea la necesidad de fortalecer los mecanismos de control y cooperación para reducir la impunidad asociada al comercio y circulación ilícita de armas.
AB This chapter provides a structured introduction to the universal and regional legal framework governing arms control and its core challenges. It first distinguishes between weapons of mass destruction and conventional weapons, outlining the main international instruments aimed at limiting or prohibiting specific categories of weapons and at reducing human suffering. It then focuses on small arms and light weapons (SALW), emphasizing their sustained impact on human security, violence, and organized crime, as well as the structural obstacles to effective regulation. The chapter reviews key universal developments related to illicit trafficking and the arms trade, and subsequently contrasts two regional regulatory experiences: the Americas (with particular attention to the inter-American framework) and Africa (through regional and sub-regional initiatives). It concludes by highlighting persistent shortcomings in implementation and accountability, and by calling for stronger control, cooperation, and responsibility mechanisms to curb impunity linked to illicit arms circulation and trade.
