AB El Tribunal Constitucional alemán consumó una doble y grave vulneración del Derecho de la UE. Ordenó no aplicar en Alemania una norma del Banco Central Europeo si no justificaba adecuadamente esa medida. Y decidió no respetar parte de la sentencia del Tribunal de Justicia de la Unión que declaraba la validez de ese acto del BCE.  El Tribunal Constitucional alemán ha quebrado la primacía y unidad misma del orden jurídico común, la exigencia fundamental de la seguridad jurídica y el principio de igualdad de los Estados miembros. Se erigió en poder constituyente alterando de hecho los Tratados.
AB The German Constitutional Court committed a double and serious violation of EU law. He ordered that a European Central Bank rule not be applied in Germany if it did not adequately justify that measure. And it decided not to respect part of the ruling of the Court of Justice of the Union that declared the validity of that act of the ECB. The German Constitutional Court has broken the very primacy and unity of the common legal order, the fundamental requirement of legal certainty and the principle of equality of the Member States. It established itself as a constituent power, de facto altering the Treaties.
