AB El trabajo aborda la relación que existe entre la finalidad del concurso y la utilización del convenio como solución prevista para el mismo. La realidad estadística demuestra que el convenio es una solución excepcional. El trabajo analiza la influencia que el fracaso del convenio tiene para la configuración del concurso como un procedimiento incompatible con la continuidad empresarial.
AB This paper deals with the relationship between the purpose of insolvency proceedings and the use of creditors’ scheme as solution foreseen for the former. Actual statistics show that schemes are an exceptional solution. The paper assesses the influence of scheme’s failure on the insolvency’s configuration as proceedings incompatible with business continuity.
