AB El trabajo aborda las diferencias y los puntos de contacto entre dos instituciones básicas del Derecho Procesal, la preclusión y la cosa juzgada, para terminar formulando la tesis de que las normas reguladoras de la preclusión y de la cosa juzgada deben ser objeto de una interpretación restrictiva en virtud de la “vertiente subjetiva” del principio de seguridad jurídica.
AB This paper deals with the differences and similarities between two of the main key notions of procedural law, namely, preclusion and res judicata. The author stresses the need to make a strict interpretation of the rules governing preclusion and res judicata, in the light of the the so-called 'subjective perspective' of the principle of legal certainty.
