T1 La institución del juez legal en la cultura jurídica secular y en la canónica

AB El juez legal es una institución cuyo origen se remonta a una Decretal del s. XII. Este trabajo analiza las garantías de este derecho fundamental en el Derecho internacional, europeo y español, para compararlas después con las del Derecho canónico vigente. En este estudio, se expone el régimen jurídico de los textos internacionales de Derechos Humanos y cómo la jurisprudencia europea y americana ha ido concretando esta institución. La jurisprudencia del TC y TS español ha declarado que el juez predeterminado por la ley, es sobre todo el órgano judicial. Sin embargo, si se sustituye a un titular integrante de ese órgano las partes han de tener posibilidad de interponer recurso frente a la designación del sustituto. En caso contrario, no estaría garantizado el juez legal. En el Derecho canónico vigente no se reconoce plenamente el derecho al juez legal de modo equiparable al Derecho internacional o español. Se anotan propuestas de lege ferenda.
AB The  legal  judge  is  an  institution  whoseorigin dates back to a 12th century Decree. This pa-per  analyzes  the  guarantees  of  this  fundamentalright  in  international,  European  and  Spanish  law,and  compares  them  with  those  in  current  canonlaw.  The  legal  rationale  outlined  in  internationaltexts  on  human  rights,  and  how  European  andAmerican jurisprudence have addressed this in realterms,  are  explored  in  this  analysis.  The  jurispru-dence of the Spanish Constitutional Court and Su-preme  Court  has  declared  that  the  judge  determi-ned  by  law  has  maximum  authority.  However,  if  amember  of  this  body  is  replaced,  the  parties  mustbe able to lodge an appeal against the appointmentof a substitute. Otherwise, the legality of the judgewould not be guaranteed. Current canon law doesnot recognize the right to a legal judge in a mannercomparable to international or Spanish law. Proposals de lege ferendaare also noted
