AB El objetivo de este trabajo consiste en el análisis de la reciente jurisprudencia del Tribunal Europeo de Derechos Humanos en materia de diversidad sexual que ofrece herramientas jurídicas a los Estados para adaptar sus legislaciones y las prácticas judiciales y administrativas para prevenir, investigar y castigar, si procede, la creciente homofobia que desafía valores como el de democracia, justicia, libertad, tolerancia y espíritu de apertura que fundamentan el Consejo de Europa.
AB The aim of this paper is to analyze the recent European Court of Human Rights case-law on sexual diversity which it offers legal tools to States to adapt their legislation and judicial and administrative practices to prevent, investigate and punish, if convenient, the growing homophobia that challenges values such as democracy, justice, freedom, tolerance and spirit of openness that underpin the Council of Europe
AB O obxectivo deste traballo consiste na análise da recente xurisprudencia do Tribunal Europeo de Dereitos Humanos en materia de diversidade sexual que lles ofrece ferramentas xurídicas aos Estados para adaptar as súas lexislacións e as prácticas xudiciais e administrativas para previr, investigar e castigar, se procede, a crecente homofobia que desafía valores como o de democracia, xustiza, liberdade, tolerancia e espírito de apertura que fundamentan o Consello de Europa
