AB Sobre el modelo legal español de despido colectivo se plantean varias  cuestiones relacionadas con su adecuación al Derecho de la UE. Entre ellas destaca la determinación legal de la unidad de referencia a efectos de configuración del despido colectivo según dispone la norma comunitaria y el margen que deja a los Estados Miembros.  El estudio describe las varias opciones legislativas nacionales  y, en concreto, la del legislador español para posteriormente fijar las reglas que, conforme a la interpretación por el TJUE,  definen el despido colectivo en su dimensión cuantitativa y, en particular, la opción por el centro de trabajo como unidad de referencia o de cómputo en la Directiva Comunitaria.
AB The Spanish Collective Redundancy  Legal Model raises several issues related to its adequacy to EU law.  For example,  the reference unit for the collective redundancies in the EU law framework and the scope of action left by the Directive to Member States. The study describes the national  options and, in particular, Spanish Law. And it analyzes ECJ rules about collective redundancies,  their quantitative dimension and the legal option by the establishment as the reference or computation unit. The EU Law precludies national legislation that introduces the undertaking and not the establishment as the sole reference unit.
