Se analiza la regulación y operatividad de los escritos preventivos contemplados en el artículo 132 de la Ley de Patentes. En concreto, se realiza un breve estudio comparado sobre los escritos preventivos, se expone su origen y evolución en nuestro ordenamiento y se examinan aspectos prácticos relacionados con su uso en el tráfico.
This paper analyzes the regulation of the protective letters in the Patent act. In particular, a brief comparative study of the regulation of the protective letters in other European countries is done, as well as an analysis on the origins and evolution of them in the Spanish legal order and on practical aspects of their use by the legal practitioners.
