En la crisis de 2008 esta cuestión ha jugado un papel destacado, al ir unida a la tendencia a la desregulación y sustitución por la autorregulación que ha imperado en los últimos treinta años, al hilo del análisis económico del derecho y de la posmodernidad en general. Se impone una reflexión sobre el papel que el derecho ha de jugar en los mercados y en la sociedad en general. ABSTRACT: The issue of distribution of power within big corporations is not new. However, it is now in the limelight as corporations have gone through economic crisis. This matter played a key role in the 2008 crisis, since it was linked to a tendency of deregulation and to the replacement made by auto-regulation which has governed during the last thirty years, all of this in connection with both the economic analysis of the Law and post-modernity.
