La Constitución de Marruecos de 2011 cumplirá en julio diez años de vigencia. Con la aparición de este nuevo texto constitucional se constituyó un nuevo marco político, social y económico en el reino alauita. En el contexto penal y procesal, daría lugar a varias reformas para adaptar el sistema penal marroquí a los principios de la nueva Constitución y a las obligaciones internacionales de derechos humanos. Este estudio trata de analizar la efectividad de esta adaptación en dos puntos específicos de relevancia constitucional y penal: la custodia policial o detención preventiva y el nivel de rigor y represión del Derecho penal.
In July the Moroccan Constitution of 2011 will be 10 years of validity. With the appearance of this new constitutional text was created a new po-litical, economic and social framework for the Alaouite Kingdom. Within the procedural and penal context, this has led to various reforms to adapt the moroccan penal system to the principles set out in the new Constitu-tion and to the international human rights obligations. This study tries to analyse the effectiveness of this adaptation in two specific issues of consti-tutional and criminal relevance: the police custody or pretrial detention in Morocco and the level of severity and repression of the penal law
