Nos encontramos ante una situación alarmante que hace que, hoy en día, sea más que nunca necesario colocar al menor investigado en una situación que no solo garantice el buen desarrollo del proceso y la efectividad de la Sentencia condenatoria que, en su caso, pudiera dictarse, sino que también procure una adecuada protección a la víctima del delito de agresión sexual. A esta necesidad responde precisamente el artículo 28 LORPM, regulador de la posible adopción de medidas cautelares en el proceso penal de menores, en cuyo estudio y análisis se centra el presente dictamen jurídico.The increasingly early access to pornography, the lack of affective-sexual education and the disturbing "call effect" that seems to have been caused by the “Wolf Pack” case, have lead to a significant increase in sexual assaults committed by young people who are below the age of criminal responsability in recent years. We are facing a critical situation which requires, now more than ever, placing the youth investigated for the crime in a situation that not only ensures the proper development of the judicial process and the effectiveness of the eventual guilty veredict, but also provides an adequate protection to the sexual assault victim.
