Actualmente, sin embargo, el propio Ministerio Fiscal se arroga esa misma atribución, so pretexto de que la investigación realizada por él o bajo su dirección es extra processum. En esta consideración, la Circular 2/2022 incide en que, junto a las clásicas diligencias de investigación preprocesal reguladas en el Estatuto Orgánico del Ministerio Fiscal y en la Ley de Enjuiciamiento Criminal, los fiscales pueden incoar las que denomina como «diligencias de investigación auxiliar» y «diligencias de investigación posprocesal». El objetivo de este trabajo es analizar el régimen diseñado para esta recién bautizadas diligencias y poner de manifiesto los riesgos que entraña su empleo.The attribution of the investigation to the Public Prosecutor's Office within the framework of the criminal process is, for many, a desideratum. Currently, however, the Public Prosecutor's Office itself arrogates this same attribution, under the pretext that the investigation carried out by it or under its direction is extra processum. In this regard, the Circular 2/2022 stresses that, in addition to the classic pre-procedural investigation proceedings regulated in the Organic Statute of Public Prosecutor's Office and in the Criminal Procedure Act, prosecutors can initiate what it calls "auxiliary investigation proceedings" and "post-procedural investigation proceedings".
