Bibliotecas digitais e os direitos autorais: a questão dos diretos conexos

Abstract

As transformações tecnológicas foram decisivas para os novos embates existentes entre os recursos informacionais e a restrição induzida de informação, principalmente quando se aborda a questão dos Direitos Autorais, dentro do contexto da Biblioteca Digital. A busca pelo equilíbrio entre a propriedade intelectual e o acesso a obras e ao conhecimento é a grande questão a ser debatida e explorada, pois ao passo que existe uma tentativa, do poder econômico, dos titulares de direitos patrimoniais e conexos de recursos informacionais de um acervo digital, existe uma demanda reprimida por informações confiáveis diante do rizoma que é a internet, sendo as Bibliotecas Digitais um lugar de informação segura e aberta. O presente trabalho aborda os aspectos dos Direitos Autorais, compreendidos em direitos de autor e os que lhe são conexos frente às complexidades existentes nas Bibliotecas Digitais. Assim, adotou-se a pesquisa de revisão bibliográfica e pesquisa documental, em que se buscou elencar os conceitos principais sobre direitos autorais e conexos, bem como as definições e realidade das Bibliotecas Digitais, pretendendo-se atingir os objetivos especificados e se pensar no uso social da informação e de como a Biblioteca Digital interage com os Direitos Autorais na sociedade contemporânea.Technological changes were decisive for new clashes between the existing information resources and the induced restriction of information, especially when dealing with the issue of Copyright, within the context of the Digital Library. The search for balance between intellectual property and access to works and knowledge is the big question being debated and explored, because while there is an attempt, the economic power of the holders of equity and rights information resources of a digital archive, there is a pent-up reliable information on the rhizome demand that is the internet, and digital Libraries a place in a safe and open information. This paper discusses aspects of Copyrights, included in the copyright and related to it front to existing complexities in Digital Libraries. Thus, we adopted the research literature review and desk research, which sought to list the main concepts of copyright and related rights, as well as definitions and reality of digital libraries, the aim being to achieve the specified goals and think about using social information and how it interacts with the Digital Library Copyright in contemporary society.
