Abstract
El presente trabajo estudia la adaptación de la protección del consumidor vulnerable digital en materia de invalidez contractual, en atención al comercio electrónico y sus externalidades negativas en forma de manipulación algorítmica, incluyendo la operada mediante sistemas de inteligencia artificial no determinista. En este sentido, se examinarán las modificaciones necesarias en los conceptos de consumidor medio y consumidor vulnerable, su protección en materia de equidad digital, y la adaptación del tratamiento legal de la anulabilidad del contrato mediante el uso de la inteligencia artificial en los casos de error vicio, influencia indebida, y ventaja injusta en las personas con discapacidad, junto con el tratamiento legal del error en la oferta de contrato generada por inteligencia artificial.
This paper examinesthe legal treatment of vulnerable digital consumers with regard to voidability of contracts, considering e-commerce and its negative effects, particularly in relation to algorithmic manipulation and non-deterministic artificial intelligence systems. In this regard, the paper will analyse consumer protection in the context of digital fairness, the legal treatment of contract voidability due to mistake and undue influence, including for people with disabilities, as well as the legal treatment of the unexpected outcomes of artificial intelligence in contractual offers.
