Refinanciaciones de deuda y responsabilidad de la banca

Abstract

La responsabilidad de las entidades de crédito que participan en refinanciaciones se aborda desde distintas hipótesis. Comenzando por la definición de refinanciación, pasando por el hecho de denegar o concederla y terminando por las varias clases de responsabilidad imaginables (concursal, societaria, administrativa, etc.). El acogimiento de una refinanciación al régimen especial establecido en la Disposición adicional cuarta LC limita notoriamente la eventual responsabilidad de las entidades crediticias. Liability of financial institutions taking part in refinancing operations is assessed on the basis of different hypothesis. Starting from the definition of refinancing, through the fact of either denying or awarding it, we end with the several sorts of imaginable liability (bankrupt, corporate, administrative, etc.). The submission of a refinancing operation to the special regulation set in the Fourth Additional Provision of the Insolvency Act patently limits the possible liability of financial institutions.
