La función del artículo 3.2 de la Ley Orgánica de Libertad Religiosa

Abstract

La celebración del 40 aniversario de la Ley 7/1980, Orgánica de Libertad Religiosa brinda la ocasión para reflexionar acerca de esta norma. La crítica que especialmente entre los años 2008 y 2010 padeció esta ley no significó su sustitución y derogación. En su lugar, mediante unas reformas reglamentarias de 2015 se solventaron cuestiones técnicas de cierta importancia. El objeto de este artículo es dar cuenta del papel de la Ley Orgánica de Libertad Religiosa en la evolución del tratamiento jurídico del fenómeno religioso en España y analizar la función que el artículo 3.2 desempeña especialmente en lo que a los grupos religiosos se refiere.

The 40th anniversary of Law 7/1980, Fundamental Law of Religious Freedom, provides an occasion to analyze this norm. The criticism that especially between 2008 and 2010 this law suffered did not lead to its replacement and repeal. Instead of that, by means of regulatory reforms in 2015, technical issues of some importance were solved. The purpose of this article is to give an account of the role of the Organic Law of Religious Liberty in the evolution of the legal treatment of the religious phenomenon in Spain and to analyze the role that article 3.2 plays especially with regard to religious groups.
