Abstract
Los créditos participativos siempre han sido necesariamente subordinados por pacto contractual. No obstante, se habían dado interpretaciones opuestas que habían generado confusión, por lo que el texto refundido de la Ley Concursal ha aclarado la cuestión. Sin embargo, se sigue insistiendo en la posibilidad de suprimir tal carácter subordinado por pacto contractual, lo que no es admisible. El carácter subordinado del crédito participativo tampoco se altera cuando es crédito de derecho público.
Participating credits have always been necessarily subordinated by contractual agreement. Nevertheless, there had been opposing interpretations that had generated confusion, so the consolidated text of the Bankruptcy Law has clarified the issue. However, it continues to insist on the possibility of suppressing such subordinate status by contractual agreement, which is not admissible. The subordinate nature of participative credit is not modified when it is a public law credit.
