Abstract
Impensable obviar la polémica figura de Carl Schmitt en el actual debate teórico en torno a la cuestión política y el modo de organizar un Estado. En el presente texto exploramos la relación de Carl Schmitt con el proceso de constitución de la República de Weimar, especialmente en su elaboración, en ese contexto, de su Teoría de la Constitución. Destacamos el papel fundamental de la crítica de Schmitt a la constitución de Weimar consagrando un Estado Social de Derecho intrínsecamente contradictorio, de manera que –quizá sin pretenderlo, en cualquier caso– su aportación permite que se superen aquellos problemas en la Ley Fundamental de Bonn. El recorrido teórico aquí expuesto permite situar, más allá del debate jurídico, el papel político de las Constituciones como documentos centrales de cualquier arquitectura política.
It is inconceivable to avoid the polemic figure of Carl Schmitt in the present theoretical debate about the political issue and the way of organizing an State. This paper explores the relationship between Carl Schmitt and the setting up process of the Republic of Weimar, especially in that context what refers to his working out of his Theory of Constitution. We stress the essential role of Schmitt’s criticism on the Weimar’s Constitution stablishing a Social Rule of Law intrinsically contradictory, so that –in any case without intending it- his contribution allows the overcome of that Fundamental Law of Bonn. The theoretical route here exposed allows to place beyond the juridical debate the political role of Constitutions as core documents of every political architecture.
