La recepción del Ius Commune por el Tribunal Superior del Sacro Imperio Romano Germánico

Abstract

En el trabajo se expone cómo y por qué se aplicaron el Derecho canónico y el Derecho romano en el extenso territorio del Sacro Imperio Romano Germánico. Buena parte de los ducados, marquesados, etc. integrados en él habían quedado siempre fuera del limes romano. Además, en los momentos en que tuvo lugar la recepción plena del Ius commune, debido a la Reforma protestante, se dejaba de reconocer la autoridad del Romano Pontífice y de los Obispos. Ello fue posible debido a que el Tribunal Superior del Imperio (Reichskammergericht) aplicó el Ius commune como Derecho supletorio en todo el Imperio. Se dedica especial atención a los procesos de súbditos conocidos por este Tribunal.

This paper explains how and why Canon Law and Roman Law were applied throughout the vast territory of the Holy Roman Empire. Much of the duchies, marquisates..., embedded in it had always remained outside the Roman limes. In addition, at the times in which the full reception of Ius commune was held, due to the Protestant Reformation, it ceased to be recognized the authority of the Roman Pontiff and the bishops. This fact was possible because the High Court of the Empire (Reichskammergericht) applied the Ius commune as supplementary law throughout the empire. Particular attention is given to the processes of individuals, subjects of the empire, acquaintances for this Court.
