Directiva sobre el comercio electrónico: determinación de la normativa aplicable a las actividades transfronterizas

Abstract

Este trabajo analiza el impacto de la Directiva sobre comercio electrónico y sus reglas sobre el mercado interior sobre el Derecho internacional privado de los Estados miembros. Para ello analiza los planteamientos contrapuestos existentes acerca del alcance conflictual del criterio de origen en dicha Directiva, entre los que toma partido. ---- This article discusses the consequences of the internal market rules of the Directive on electronic commerce on the systems of Private International Law of the Member States. In this connection, the diverging views about the significance of the lex originis in the framework of the electronic commerce Directive are examined in order to determine the requirements imposed on the national rules implementing the Directive.
