Entre norma y soberanía: el papel de la voluntad en el fundamento del derecho en Kelsen y Hobbes

Abstract

El presente trabajo pretende desarrollar una discusión entre Hobbes y Kelsen en torno a la cuestión del fundamento del derecho. La pregunta central que atraviesa esta tesis es si el fundamento del derecho puede identificarse con la voluntad subjetiva, como lo plantea Hobbes, o con algún tipo de elemento normativo (una norma fundante básica como presupuesto lógico trascendental) como lo plantea Kelsen. Al respecto, la disertación defiende la siguiente tesis: el debate entre Hobbes y Kelsen muestra que es imposible excluir a la subjetividad y su voluntad de la fundamentación del derecho. Esto implica afirmar que la teoría hobbesiana guarda cierta superioridad frente a la propuesta de Kelsen.This work aims to develop a discussion between Hobbes and Kelsen on the question of the foundation of law. The central question running through this dissertation is whether the foundation of law can be identified with the subjective will, as Hobbes posits, or with some kind of normative element (a basic foundational norm as a transcendental logical presupposition) as Kelsen posits. In this respect, the dissertation defends the following thesis: the debate between Hobbes and Kelsen shows that it is impossible to exclude subjectivity and its will from the foundation of law. This implies affirming that the Hobbesian theory has a certain superiority over Kelsen's proposal.
