Abstract
Los cambios tecnológicos de la última década han tenido un impacto fundamental en el comercio transfronterizo que se realiza por medios digitales, que ha devenido en una realidad cotidiana para los consumidores europeos y de la mayor parte del mundo. Esto ha obligado al legislador de la Unión Europea, consciente del impacto de estos cambios en el mercado único, a adecuar su acervo normativo a esta incontestable realidad. Este trabajo de investigación estudia el régimen jurídico establecido en la Unión Europea para los contratos de suministro de contenidos y servicios digitales. Aunque no haya tenido tan amplia repercusión como otras disposiciones más recientes (entre las que pueden citarse el Reglamento (UE) 2022/1925 sobre mercados digitales, o el Reglamento (UE) 2024/1689 por el que se establecen normas armonizadas en materia de inteligencia artificial), la Directiva (UE) 2019/770, relativa a determinados aspectos de los contratos de suministro de contenidos y servicios digitales, constituye uno de los más interesantes desarrollos legislativos adoptados en la Unión Europea en los últimos años en el ámbito del derecho de consumo. The technological changes of the last decade have had a fundamental impact on cross-border trade conducted by digital means. It is now a daily reality for consumers in Europe and in much of the world. This has forced the European Union legislator, aware of the impact of these changes on the single market, to react in order to adapt the EU regulatory acquis to this undeniable reality.This research paper examines the legal regime established in the European Union for contracts for the provision of digital content and services. It has not had such a wide impact as other more recent provisions (including Regulation (EU) 2022/1925 on digital markets, or Regulation (EU) 2024/1689 laying down harmonised rules on artificial intelligence). But Directive (EU) 2019/770 on certain aspects of contracts for the supply of digital content and services, is one of the most interesting legislative developments adopted in the European Union in recent years in the field of consumer law.
