Luis I, un reinado breve y un debate constitucional

Abstract

Esta tesis trata del rey Luis I (1707-1724), y está desarrollada en dos partes: La primera de ellas versa sobre su figura, desde su nacimiento a su muerte: su vida privada, especialmente su adolescencia y las mujeres que le rodearon; su vida pública, como rey y la actividad del Gabinete, así como de las fiestas, juegos y vida cotidiana; la iconografía en pintura, joyería, numismática…; la casa del Rey, sus precedentes, su estructura y las funciones principales; su última enfermedad y muerte, así como sus funerales. La segunda, sobre la abdicación de la corona y la recuperación de la misma por su padre, Felipe V; las verdaderas razones de la abdicación y sus precedentes; se editan los textos legales y se desarrollan los problemas jurídicos de la renuncia, así como los diferentes casos que se han dado en la historia europea; se describen nuestros antecedentes históricos en materia de minorías de edad e incapacitaciones, la falta de un verdadero modelo, las figuras de la tutoría y regencia y gobernación; las diferentes consultas al Consejo de Castilla y a la Junta de Teólogos, para acabar manteniendo que no había jurídicamente ningún argumento para esa recuperación. Termina esta tesis con unas breves conclusiones donde se tratan los motivos que han llevado al autor a desarrollar esta figura histórica, el esquema seguido para ello, y las teorías que se mantienen en contra de la opinión mayoritaria.

This thesis is about king Luis I (1707 - 1724) and is developed two parts: The first one deals with his figure, from his birth to his death: his private life, specially his adolescence and the women who surrounded him; his public life as king and the activity of the Cabinet, as well as the parties, games and daily life; It also studies the iconography in painting, jewelry, numismatics... the King's house, its precedents, its structure and main functions; his last illness and death, as well as his funerals. The second one, on the abdication of the crown and its recovery by his father, Philip V; the real reasons for the abdication and its precedents; the legal texts are edited and the legal problems of the resignation are developed, as well as the different cases that have occurred in European history; our historical antecedents in the matter of minorities of age and incapacitation are described, the lack of a true model, the figures of the guardianship, regency and governorship; the different consultations to the Council of Castile and the Board of Theologians, to end up maintaining that there was not, legally, any argument for that recovery. This thesis ends with some brief conclusions where the reasons that have led the author to develop this historical figure, the scheme followed for it, and the theories that are maintained against the majority opinion are discussed,
