La nueva regulación del sistema bancario español

Abstract

Este estudio ofrece una primera visión panorámica de la nueva regulación del sistema bancario español establecida en la Ley 10/2014, de 26 de junio, de Ordenación, Supervisión y Solvencia de Entidades de Crédito (LOSSEC) y en el Real Decreto 84/2015 (RD 84/2015) que transforman profundamente la arquitectura regulatoria del mercado bancario y del mercado de instrumentos financieros españoles para adaptarla al nuevo entorno del Derecho comunitario de los mercados financieros. En concreto, esta LOSSEC y el RD 84/2015 adaptan las condiciones de acceso y de ejercicio de la actividad bancaria por parte de las entidades de crédito, así como su supervisión y sanción por el Banco de España a los mandatos del Reglamento (UE) nº.575/2013 y de la Directiva 2013/36/UE.

This study provides a first overview of the new regulation of the Spanish banking system established by the Act 10/2014, of 26 June, of Ordination, Supervision and Solvency of Credit Institutions (LOSSEC) and the Royal Decree 84/2015 (RD 84/2015) that profoundly transforms the regulatory architecture of the Spanish banking market and markets in financial instruments in order to adapt them to the new environment of European Union Law on financial markets. Specifically, this LOSSEC and RD 84/2015 fits the conditions of access and exercise of banking activities by credit institutions, as well as monitoring and sanctioning by the Bank of Spain to the mandates of Regulation (EU) nº.575/2013 and of Directive 2013/36/EU.
