Abstract
Esta contribución analiza el ámbito de aplicación territorial de la nueva normativa relativa a la publicidad sobre criptoactivos presentados como objeto de inversión, valorando la aplicación en esta materia del criterio de las actividades dirigidas. Se examinan también las implicaciones que resultan del criterio del mercado interior respecto de su aplicación a determinados sujetos establecidos en otros Estados miembros de la UE. Asimismo, se valora la adecuación, desde la perspectiva internacional, de las medidas frente a la publicidad ilícita que contempla la legislación española en este sector.
This contribution examines the territorial scope of application of the new Spanish restrictions on advertising of cryptoassets. The instrument adopted by the Spanish National Securities Market Commission is intended to protect investors and its territorial scope is based on the targeting criterion. It also considers the implications of the internal market criterion with respect to the application of the new restrictions to subjects established in other EU Member States. Likewise, the adequacy, from an international perspective, of the measures against illegal advertising envisaged by Spanish legislation in this sector is also assessed.
