Abstract
La evolución tecnológica y la aparición de los entornos digitales ha terminado afectando a los derechos fundamentales de las personas y se ha hecho preciso reconocer derechos nuevos o proteger con facultades nuevas derechos ya existentes. La Ley Orgánica 3/2018 de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales ha regulado, por primera vez en nuestro ordenamiento jurídico, como tal categoría específica, los llamados derechos digitales. Un significativo avance en un camino en el que todavía queda mucho por resolver. El 14 de junio de 2021, el Gobierno adoptó la Carta de Derechos Digitales, un documento carente de eficacia normativa que supone un paso más en el proceso y que supone un punto de partida cualificado de cara a posteriores regulaciones de la materia.
Technological evolution and the appearance of digital environments have ended up affecting the fundamental rights of people and it has been foressen that new rights or new existing rights are protected with powers. Orgaanic Law 3/2018, of December 5, about Protection of Personal data and guarantee of digital rights has regulated, for the first time in our legal system, as such a category specifies, the so called digital rights. A significant advance in a path in wich much remains to be resolved. On june 14, 2021, the Government addopted the Digital Rights Charter, a constant document of regulatory effectiveness that represents another step in the process and a highly qualified starting point of subsequent regulations in the matter
