Abstract
The present work aims to make an approach to the question related to the recurrent involvement of older workers in company restructuring processes and its possible impact in relation to the violation of the right to non-discrimination recognized in Article 14 EC. We are faced with an issue of enormous importance, not only because of what it means to expel from the labour market a large group of experienced and well-distanced workers, but also in terms of the impossibility of the system of assuming the costs arising from these decisions. To this end, after going through the case law to this effect, we will assess the virtuality of the measures implemented to alleviate this massive affectation as a previous step to make some reflections on the matter
