Las licencias GPL y Creative Commons. Hacia un nuevo marco jurídico de la cesión de derechos de autor

Abstract

Durante los últimos veinticinco años la tecnología ha evolucionado a un ritmo vertiginoso saltándose cualquier predicción o teoría al respecto, cambiando nuestra concepción sobre las relaciones personales, modelos de negocio o de intercambio, uso o reutilización de las producciones culturales. Dentro de ésta nueva concepción, en éste trabajo, se intentará analizar como surgen las llamadas licencias libres, tanto para software como para obras escritas u audiovisuales, así como su adaptación a la legislación española. Estos conceptos han sido conceptos acuñados en un ámbito privado para luego ser reconocidos por distintas normativas y tribunales. ABSTRACT: During the last twenty years, technology has evolved so fast that skipped any prediction or theory about it, changing our conception of personal relationships, business models and the use of cultural product. Under this new concept, this work analyse a new model of copyright management. This model, based in the born the free licenses for use this rights, has changed our way to see all the copyright system. Adaptation to Spanish Law, new contract models and evolution of this new ways of thinking copyright are object of study in this work too. These concepts are concepts created in a private and then be recognized by different regulations and court.
