National Report: Protection of abducting mothers in return proceedings: intersection between domestic violence and parental child abduction, POAM Proyect

Abstract

This report analyses the intersection between domestic violence and international parental child abduction in Spanish legal system. In particular, it focuses on the operation of the Regulation 606/2013 (Protection Measures) and the Directive 2011/99 (European Protection Order) in the context of return proceedings involving allegations of domestic violence, under the 1980 Hague Convention on the Civil Aspects of International Child Abduction and the Council Regulation 2201/2003 of 27 November 2003 (‘Brussels IIa’).
