Abstract
En línea con la preocupación que se detecta en el Consejo de Europa y en otras instancias europeas e internacionales sobre determinados expresiones que pueden constituir insultos por pertenencia a determinados grupos religiosos o agravios u ofensas a los sentimientos religiosos de los individuos, aunque no constituyan propiamente delitos de odio tipificados penalmente, en este trabajo nos planteamos la necesidad de avanzar en la tutela de la libertad religiosa desde el entorno escolar esencialmente propicio para el desarrollo de este tipo de ofensas. El punto de partida de nuestro planteamiento es anticipar medios alternativos para la prevención de conflictos que permitan erradicar este tipo de actuaciones y crear un ambiente de tolerancia, indispensable para vivir en sociedades caracterizadas por la diversidad religiosa y cultural
In line with the concern detected in the Council of Europe and other European and international instances regarding certain expressions that may constitute insults due to membership of certain religious groups or offenses against the religious feelings of individuals, even though they do not strictly speaking constitute criminally defined hate speech, in this paper we consider the need to make advantage in the protection of religious freedom of the school environment that is essentially conducive to the development of this type of offense. The starting point of our approach is to anticipate alternative means for the prevention of these conflicts that will make it possible to eradicate this type of actions and create an atmosphere of tolerance, essential for living in societies characterized by religious and cultural diversity.
