La igualdad de oportunidades en el trabajo desde una perspectiva de género en la jurisprudencia europea

Abstract

Este texto identifica las limitaciones actuales en la conceptualización y desarrollo de la igualdad de oportunidades desde una perspectiva de género en el ámbito laboral europeo. Para alcanzar este objetivo, comprobar la evolución de este derecho y caracterizar su estatus, se analiza la evolución de diversos instrumentos normativos. En primer lugar, se realiza un repaso de los Tratados europeos que abordan esta cuestión, así como de las Directivas que los concretan. Asimismo, se caracteriza el papel del Tribunal de Justicia de la Unión Europea y del Tribunal Europeo de Derechos Humanos a través del estudio de sus principales sentencias

This paper aims to identify current limitations in the conceptualisation and development of equal opportunities from a gender perspective in the European workplace. To achieve this objective, to verify the development of this right and characterise its status, the evolution of various regulatory instruments is analysed. First, a review is conducted of the European treaties that address this issue, as well as the Directives that specify them. It also characterises the role of the Court of Justice of the European Union and the European Court of Human Rights through a study of its main judgments.
