dc.descriptionRESUMEN: En el momento presente, el elenco de normas jurídicas existentes resulta manifiestamente inadecuado para atender al fenómeno descrito al carecer los operadores jurídicos de unas regulaciones específicas en materia de la IA, teniendo que subsumir los problemas que van presentándose en la normativa referida a uso de la informática en entornos abiertos; la referida a la protección de datos personales en el ámbito digital y, en general, la relativa a la protección de los derechos fundamentales y la propiedad intelectual e industrial. La velocidad de desarrollo y aplicación de la IA exige, además, un esfuerzo suplementario de simplicidad y flexibilidad que permita una resolución de litigios acompasada a la rapidez de su desenvolvimiento. La Unión Europea dirige sus esfuerzos regulatorios hacia la cobertura del nuevo campo abierto por los avances tecnológicos intentando que la arquitectura jurídica continúe apoyándose, también en este ámbito, en los valores deducidos de sus Tratados fundacionales. En este artículo se exponen los contenidos mas relevantes de las propuestas que han sido realizadas por las instituciones europeas antes de la aprobación de la Ley de Inteligencia Artificial de la UE el 24 de mayo de 2024.
dc.description.abstractABSTRACT: Up to now, the list of existing legal norms has been manifestly inadequate to address the phenomenon described as legal operators lack specific regulations on AI, having to subsume the problems that are arising in the regulations referring to the use of computing in open environments; the one referring to the protection of personal data in the digital field and, in general, the one relating to the protection of fundamental rights and intellectual and industrial property. The speed of development and application of AI also requires an additional effort of simplicity and flexibility that allows a dispute resolution in step with the speed of its development. The European Union is directing its regulatory efforts towards covering the new field opened by technological advances, trying to ensure that the legal architecture continues to be based, also in this area, on the values deduced from its founding Treaties. This articule exposes the most relevant contents of the proposals that have been made by the European Institutions before the approval of the EU AI Act on 24th May 2024.
