Abstract
La siguiente operación de comercio exterior trata sobre la exportación de jamón ibérico envasado al vacío desde España a Hong Kong, un producto gourmet de alto prestigio con gran reconocimiento a nivel mundial. Ésta se articula a través de la intermediación de VENSPA TRADE AGENTS S.L., una sociedad constituida por los integrantes de este proyecto que pone en contacto al exportador del producto, Dehesas del Múrtiga S.L., con el importador en Hong Kong, The Spanish Pantry HK Limited. Esto comporta la existencia de dos tipos de relaciones jurídicas claramente diferenciadas. En primer lugar, la firma de un contrato de agencia entre Dehesas del Múrtiga S.L. y VENSPA TRADE AGENTS S.L., y en segundo lugar un contrato de compraventa internacional entre el exportador y el importador previamente mencionados. El medio de pago acordado por ambos es el crédito documentario pagadero a la vista con las características de irrevocable y confirmado. El transporte de la mercancía correctamente embalada y paletizada se realiza por vía marítima y en contenedor Reefer bajo el INCOTERM 2010 CIF Puerto de Hong Kong, según las condiciones acordadas en la operación.
This foreign trade transaction refers to an export of vacuum packed Iberian ham from Spain to Hong Kong, a gourmet product with high prestige and great worldwide recognition. This transaction is articulated through the intermediation of VENSPA TRADE AGENTS S.L., a company formed by the members of this project in charge of connecting the exporter of the product, Dehesas del Múrtiga S.L., with the importer in Hong Kong, The Spanish Pantry HK Limited. This implies the existence of two distinct types of legal relations. First, the signature of an agency agreement between Dehesas del Múrtiga S.L. and VENSPA TRADE AGENTS SL, and secondarily an international sales contract between the exporter and the importer previously mentioned. The means of payment, agreed by both parties, is the documentary credit payable at sight with the characteristics of irrevocable and confirmed. The shipment of properly packed and palletized goods is carried by sea in a Reefer container under the INCOTERM 2010 CIF Port of Hong Kong, according to the terms agreed in the operation.
