El trabajo social familiar: una ayuda para el sistema judicial en las crisis conyugales

Abstract

La Teoría General de Sistemas unificada en los años treinta por Ludwig Von Bertalanffy (1986, pp. 69 y ss.), propone un dinamismo e interpenetración entre las dimensiones del fenómeno estudiado. Urie Bronfenbrenner (1987, pp. 23 y ss.) estudia los sistemas desde una ecología del desarrollo humano. El sistema profesional del trabajo social tiene un lugar en el macrosistema del estado social, se integra en la ecología de la acción social y transita de forma discreta por otros sistemas. En esta investigación se traza su viaje dentro de los equipos psicosociales de los juzgados de familia en España; el recorrido empieza en el año 1982, tras la promulgación de la ley del divorcio de 1981. El segundo sistema objeto de estudio es el familiar. La familia evoluciona en este periodo en su estructura, en su rol y en las transiciones que realiza, pero sigue siendo una institución fundamental para los españoles. El tercer sistema es el judicial. Los trabajadores sociales se integran en la estructura de los juzgados de familia y desarrollan sus funciones profesionales asesorando la labor judicial, dentro de los equipos psicosociales...

The General Systems Theory unified in the thirties by Ludwig Von Bertalanffy (1986, pp 69) proposes a dynamism and interpenetration between the dimensions of the phenomenon studied. Urie Bronfenbrenner (1987, pp. 23) studied the systems from the environment of human development. The professional system of social work has a place in the macro system of the social state; it is integrated in the ecology of social action and passes in a discreet manner through other systems. In this research the journey through the psychosocial teams in family courts in Spain is drawn; the tour starts in the year 1982 after the enactment of the Divorce Law in 1981. The family system is the second objective of study. Families evolve in this period in their structure, their role and in the transitions that are carried out, however it remains a fundamental institution for the Spanish people. The judicial system is the third focus of study. Social workers are integrated into the structure of family courts and develop their professional functions advising the judicial work, within the psychosocial teams. The map establishing the relationship among the three systems begins to take shape when two spouses, who are also parents, decide to separate. They cannot agree on the way to do it and go to court so that the judicial system decides for them on how their family organisation is going to be in the future...
