Abstract
La presente tesis doctoral persigue conocer cómo se ha llevado a cabo el proceso de implantación de la transparencia en los municipios españoles, a partir de la aparición de la Ley española de transparencia en 2013. Las técnicas de investigación empleadas han sido una encuesta respondida por 339 ayuntamientos, encuadrados en todas las provincias y CCAA, así como entrevistas en profundidad a expertos responsables de la transparencia municipal.La tesis comienza con una revisión académica sobre los diversos estudios de la transparencia en el ámbito local, presentando el marco conceptual de la misma como valor central en las actuales sociedades democráticas. El análisis del marco jurídico se realiza en dos capítulos centrados respectivamente en la normativa estatal –antecedentes, características y contenido de la Ley 19/2013, de Transparencia, Acceso a la Información Pública y Buen gobierno y de su reglamento en tramitación-, así como en la regulación de la transparencia en la Administración local, revisando para ello las normativas autonómicas en la materia que resultan aplicables a los ayuntamientos, así como los reglamentos y las ordenanzas locales...
The present doctoral thesis seeks to know how the process of introducing transparency in Spanish municipalities has been carried out since the appearance of the Spanish Transparency Law in 2013. The research techniques employed have been a survey answered by 339 city councils, framed in all the provinces and the Autonomous Communities, as well as in-depth interviews with experts responsible of municipal transparency.The thesis begins with an academic review on the various studies of transparency at the local level, presenting its conceptual framework as a central value in current democratic societies.The analysis of the legal framework is carried out in two chapters focused respectively on the state regulation -antecedents, characteristics and content of Law 19/2013, on Transparency, Access to Public Information and Good Governance and its development regulation in process-, as well as in the regulation of the transparency in the local Administration, reviewing for it the autonomic norms in the matter that are applicable to the city councils, as well as the local ordinances...
