Abstract
Este artículo tratará de realizar un examen crítico de la reciente decisión del Comité de Derechos Humanos en el caso Francisca Alomar y otros c. España sobre la base de varios aspectos clave del sistema general de la Responsabilidad Internacional del Estado y del Derecho de los Tratados. Para ello, el análisis se dividirá en dos partes: en la primera, a partir de la teoría general propia a los hechos ilícitos continuados, se estudiará la resolución del Comité respecto a la alegación presentada como víctimas indirectas de las desapariciones forzadas denunciadas. En la segunda, se abordará la solución ofrecida en cuanto a la consideración de las autoras como víctimas directas de aquellos hechos, utilizando como pieza central de análisis al principio general del agotamiento de los recursos internos.
This article will attempt to critically examine the recent decision of the United Nations Human Rights Committee in the Francisca Alomar et al. v. Spain case based on several key aspects of the general system of the International Responsibility of the State and Law of Treaties. In order to do so, the analysis will be divided into two parts: In the first one, based on the general theory of continuing wrongful acts, the Committee's resolution regarding the allegation presented as indirect victims of reported forced disappearances will be studied. In the second one, the solution offered regarding the consideration of the authors as direct victims of those events will be addressed, using the general principle of exhaustion of domestic remedies as the central piece of analysis.
