La conformidad del acusado con discapacidad intelectual

Abstract

Este artículo analiza las vicisitudes y antinomias de la conformidad prestada por un acusado con discapacidad intelectual: así, en primer lugar, se argumenta y defiende que la discapacidad no es una razón suficiente para privar a nadie de su capacidad para prestar su conformidad válidamente, máxime a raíz de la reforma operada por la Ley 8/2021. En segundo lugar, se explora en detalle las especialidades que debe presentar la conformidad, prestando especial atención al consentimiento libre e informado y al contenido del control judicial del mismo. Por último, se estudia el tratamiento procesal de oficio y a instancia de parte que debe darse a las conformidades prestadas sin conocimiento jurídico de las consecuencias del acto o sin reunir la libertad material exigida por la naturaleza del acto procesal.

This article analyses the vicissitudes and antinomies of the consent given by a defendant with intellectual disability during plea bargaining: thus, firstly, it argues and defends that disability is not a sufficient reason to deprive anyone of their ability to give their consent validly, especially as a result of the reform operated by Law 8/2021. Secondly, it explores in detail the special features of consent, paying special attention to free and informed consent and the content of its judicial control. Finally, we study the procedural treatment, ex officio and at the request of a party, that must be given to consents given without knowledge of the legal consequences of the act or without meeting the material freedom required by the nature of the procedural act.

In diesem Artikel werden die Wechselfälle und Antinomien der Verständigung eines Angeklagten mit einer geistigen Behinderung analysiert: Zunächst wird argumentiert und verteidigt, dass eine Behinderung kein ausreichender Grund ist, um jemandem die Fähigkeit zu nehmen, eine gültige Verständigung zu erteilen, insbesondere nach der durch das Gesetz 8/2021 eingeführten Reform. Zweitens werden die besonderen Merkmale, die eine solche Verständigung aufweisen muss, eingehend untersucht, wobei der freien und informierten Einwilligung und dem Inhalt ihrer gerichtlichen Kontrolle besondere Aufmerksamkeit gewidmet wird. Schließlich wird die verfahrensrechtliche Behandlung untersucht, die von Amts wegen und auf Antrag der Partei bei einer Verständigung erfolgen muss, die ohne rechtliche Kenntnis der Folgen der Handlung oder ohne die nach der Art der Verfahrenshandlung erforderliche materielle Freiheit erteilt wird.
