Robots dotados de inteligencia artificial: su posible personalidad jurídica y responsabilidad por daños

Abstract

La Inteligencia Artificial es la revolución tecnológica más importante acaecida hasta el día de hoy. Esta disciplina científica crea programas informáticos que ejecutan operaciones similares a las que realiza la mente de una persona humana, como el aprendizaje o el razonamiento. Por tanto, dotar de IA a máquinas supone la creación de robots inteligentes y autónomos, capaces de llegar a tomar decisiones de forma independiente a la voluntad de sus creadores o dueños, actuaciones que escapan a la lógica humana. Esto plantea para el Derecho todo un reto jurídico pues la existencia de estos robots suscita ciertas preguntas clave; ¿adquirirán personalidad jurídica propia? Y, ¿cómo será el sistema de responsabilidad civil en caso de daños causados por robots inteligentes artificialmente?

Artificial Intelligence is the most important technological revolution that has occurred to date. This scientific discipline creates computer programs that perform operations similar to those carried out by the human mind, such as learning or reasoning. Therefore, equipping machines with AI supposes the creation of intelligent and autonomous robots, capable of making decisions independently of the will of their creators or owners, actions that escape human logic. This raises a legal challenge for the Law, as the existence of these robots raises certain key questions; Will they acquire their own legal personality? And what will the civil liability system look like in case of damages caused by artificially intelligent robots?
