Permanencia del acta de misión en la práctica arbitral

Abstract

Aunque no se ha generalizado el empleo del Acta de Misión ha ido consolidándose y generalizándose en la práctica arbitral. Dicho empleo ofrece innumerables ventajas pese a su inevitable formalismo y pese al empleo de un esfuerzo adicional para las partes y para el tribunal arbitral. Los modernos Reglamentos de arbitraje, no sólo regulan el acta sino que ofrecen cada vez más precisión en orden a su contenido en un afán superador de las tradicionales críticas al modelo. El Acta de Misión con-tribuye de manera significativa al éxito del procedimiento arbitral; en particular, por la precisión de las cuestiones en disputa, lo que aumenta la eficacia de la audiencia posterior y, en un número significativo de casos, por demostrar que las posiciones jurídicas de las partes no son tan diferentes, creando así las condiciones para una posible transacción.

Although no widespread use of the Terms of Reference, it has been consolidated and generalized in arbitration practice. Such employment offers many advantages despite its inevitable formalism and despite the use of an additional effort for the parties and the arbitral tribunal. Modern arbitration rules not only regulate the terms of reference but offer increasingly precise order of their content on a desire to overcome the traditional criticism of the model. The Terms of Reference significantly contribute to the success of the arbitration proceedings; in particular the accuracy of the matters in dispute, which increases the effectiveness of subsequent hearing and in a significant number of cases, to prove that the legal positions of the parties are not that different, thus creating the condi-tions for a possible transaction.
