Arbitraje y reconocimiento de resoluciones judiciales en el Reglamento Bruselas I bis

Abstract

La jurisprudencia reciente del Tribunal de Justicia restringe la posibilidad de que una sentencia dictada en un Estado miembro en los términos de un laudo arbitral pueda ser invocada con éxito en el marco del Reglamento 1215/2012 para oponerse al reconocimiento de una resolución judicial inconciliable dictada en otro Estado miembro. La observancia de las disposiciones y objetivos fundamentales del Reglamento Bruselas I bis en el laudo arbitral al que se refiere la resolución judicial en cuestión se configura como presupuesto de la aplicación del motivo de denegación del reconocimiento previsto en el artículo 45.1.c) del Reglamento. Se analizan ciertas implicaciones de esta jurisprudencia y la conveniencia de una interpretación comedida del criterio que establece.Recent case law of the Court of Justice restricts the possibility for a judgment rendered in a Member State in the terms of an arbitration award to be successfully invoked under Regulation 1215/2012 to oppose the recognition of an irreconcilable judgment rendered in another Member State. Compliance with the fundamental provisions and objectives of the Brussels I bis Regulation in the arbitral award at issue is deemed as a prerequisite for the application of the ground for refusal of recognition provided for in Article 45(1)(c) of the Regulation. Some implications of this case law and the convenience of a measured application of the criterion on which it is based are analyzed.
