La iniciativa legislativa del gobierno en México

Abstract

La investigación persigue concretar un análisis de la iniciativa legislativa del Gobierno en México, que se examina desde las distintas aristas, bajo un nuevo equilibrio entre poderes dentro de un Congreso sin mayorías. Se estudia su evolución constitucional histórica, la elaboración de la iniciativa por parte de los órganos del Gobierno, la tramitación ante las instancias del Poder Legislativo y la relación que genera entre ambos poderes. Síntesis Se hace un análisis de la iniciativa legislativa bajo los antecedentes constitucionales de la misma, adentrándose en el estudio de la primera constitución vigente en México, que es la de Cádiz de 1812, además de la primera constitución mexicana de 1824, las leyes constitucionales centralistas de 1836 y la vuelta a los elementos federales de la Constitución de 1857. Asimismo, se analizan las figuras constitucionales dentro de la normativa vigente establecidas en la Constitución de 1917, así como en las reformas realizadas en la última época. Se examina el desarrollo y elaboración de la iniciativa legislativa del Gobierno, a través de los órganos involucrados, especialmente la Secretaría de Gobernación y la Consejería Jurídica del Ejecutivo Federal; así como las instancias de apoyo jurídico de las diversas dependencias gubernamentales, y el análisis de los dictámenes en materia del impacto presupuestario y la mejora regulatoria...

The research aims to perform an analysis of the legislative initiative of the government in Mexico, examined from different angles, under a new balance of power within Congress without majorities. Studied is the the historical constitutional development, the development of the initiative by Government bodies, the proceedings before the bodies of the legislature and the relationship generated between the two powers. Synthesis An analysis is done of the legislative initiative under the constitutional history of Mexico, into the study of the first constitution in force, that being Cadiz in 1812. Additionally analyzed is the first Mexican constitution of 1824, the constitutional laws of 1836 and the federal elements of the Constitution of 1857. Lastly studied are the constitutional figures within the current regulations established in the Constitution of 1917 as well as reforms in the last period. Examined are the the development and production of the legislative initiative of the government through the organs involved, in particular the Interior Ministry and the Legal Counsel of the Federal Executive. Further studied are instances of legal support of various government agencies under review in addition to analysis opinions on the budget impact and regulatory reform. Once the project by law is carried out by the Government, the parliamentary process is studied as well as how to get involved in organizations such as the conference of legislative work of the Chamber of Deputies, the board policy coordination and work within the legislative committees...
