Abstract
Esta investigación doctoral, inspirada en la riqueza histórica de nuestra Tradición Jurídica y específicamente en el papel unificador, articulado y práctico que existió en el Ius Commune medieval (vigente durante aproximadamente ocho siglos), propone la aplicación de diversas herramientas hermenéuticas en aras de una mejor recepción del Derecho Internacional -y Procesal- de los Derechos Humanos para este Tercer Milenio. Particularmente, los principios de margen de apreciación nacional e interpretación concurrente del Sistema Europeo podrían servir para enriquecer la interpretación conforme aplicada en el ámbito del Control de Convencionalidad del Sistema Interamericano, a fin de permitir la adecuación de los Derechos Humanos nacionales al corpus iuris supranacional y viceversa. Asimismo, el propósito de cada uno de los nueve capítulos es trazar someramente algunas de las tendencias que han hecho necesaria y conveniente una reflexión de fondo -histórica, jurídica y práctica- sobre la estructura y conformación de un nuevo Derecho Común del ser humano.
This doctoral research, inspired by the historical richness of our legal tradition and specifically in the unifying, articulated and practical role played by the medieval Ius Commune (in force for approximately eight centuries), proposes the application of various hermeneutic tools for a better reception of the International Law -both Substantive and Procedural- of Human Rights for this Third Millennium. Particularly, the principles of margin of appreciation national and concurrent interpretation of the European System could serve to enrich the interpretation in conformity applied in the field of the Control of Conventionality of the Inter-American System, to allow the adequacy of national Human Rights to the supranational corpus iuris and vice versa.Likewise, the purpose of each of the nine chapters is to briefly outline some of the trends that have made necessary and convenient a deep reflection -historical, juridical and practical- on the structure and conformation of a new Common Law of the human being.
